Terms & Conditions
- The right is reserved to withhold publication of any advertisement/inserts and to cancel any advertisement/inserts order which has been accepted without assigning any reasons therefore. No liability is accepted for losses arising from omissions, failure to publish, and publication of “wrong” material, typographical errors or any mistake or error of whatever kind of nature.
- 50% Cancellation fee will be charged for cancellations made after the booking deadline as per rate card.
- All orders below R5000 are payable on booking deadline date. No alterations can be made to this quote, once accepted.
- Acceptance of an order shall only occur once NEW MEDIA PUBLISHING has duly considered and approved the order. No contractual obligations shall arise merely as a result of the completion of an order form.
- The right is reserved to withhold publication of any advertisement or to cancel any advertisement order which has been accepted without stating any reasons therefore. No liability is accepted for losses arising from omissions, failure to publish or unsatisfactory positioning of an advertisement.
- No advertisement orders containing the condition that editorial/write-up space will be dedicated to the Advertiser, or any other conditions relating to positioning, will be accepted.
- The Advertiser will furnish copy for processing before the closing date.
- NEW MEDIA PUBLISHING does not guarantee any results in respect of advertisements inserted in any of its magazines and/or supplements.
- No cancellation of advertisements will be accepted after the fixed closing dates to our booking deadline date as per ratecard which is available or requested.
- NEW MEDIA PUBLISHING reserves the right to increase the rates at any time. When new rates are announced, the previous rates will only apply to orders received before the announcement for a period of 60 days after the announcement. The Advertiser may cancel his/her new order on the date the new rate becomes effective, subject to at least 6 (six) weeks written notice being given.
- The Advertiser consents that NEW MEDIA PUBLISHING may carry out any credit enquiries.
- A certificate purported to be signed by a responsible official of NEW MEDIA PUBLISHING will be prima facie proof of the amount plus interest due by the advertiser at any time.
- All rates are strictly nett. Accounts will be rendered monthly and will be payable within 30 days of date of statement. Interest on arrears shall be payable at maximum rates as determined in ACT 73 of 1968.
- In the event of payment not being made by the Advertiser on/before the due date, the full balance outstanding will immediately become due, owing and payable.
- The Advertiser will be liable for all damages and costs that may arise from any action which may be instituted against NEW MEDIA PUBLISHING as a result of the publication of an advertisement.
- The Advertiser consents to the jurisdiction of the Magistrate’s Court, notwithstanding the possibility that any amount claimed could fall outside the jurisdiction of the Magistrate’s Court, and further undertakes to pay all legal expensed incurred, including cost on an attorney-client scale, collection charges and tracing fees, in the recovering of all amounts due to NEW MEDIA PUBLISHING.
- The Advertiser undertakes to notify NEW MEDIA PUBLISHING in writing within 7 (seven) days of any change of address.
- The Advertiser undertakes, notwithstanding any sale of its business, an/or change of its members, to accept the liability of settling its debt to NEW MEDIA PUBLISHING in full.
- The Advertiser warrants the authority of the signatory to this Agreement and warrants the correctness of the information in this application.
- The street address mentioned in page 1, has been chosen as domicilium citandi et executandi for any purpose, action or payment as far as this application is concerned.
- The above mentioned Terms & Conditions may not be altered unless approved by NEW MEDIA PUBLISHING Executive Management.
